Verify rental use before it becomes a purchase assumption.

A rental listing, a past permit and a property advertised as an STR are starting points. None independently proves that a new owner can operate the same way.

Use the right jurisdiction

Town of Pagosa Springs: rentals under 30 consecutive days require a vacation-rental license. Planning guidance describes conditional-use approvals as nontransferable; verify the current code and new-owner path with the town.

Unincorporated Archuleta County: the published April 2025 code generally requires a new owner to apply for a new permit. It includes limited ownership-transfer exceptions. Ask the county how bookings, advertising and closing dates must be handled in your transaction.

Do not generalize across La Plata County

City of Durango: sale or transfer invalidates the permit; the city also describes zone limits, waitlists and explicit permission in governing documents.

Town of Bayfield: the published summary describes a cap of 30 and spacing over 500 feet. Current availability and transferability are not established here.

Unincorporated La Plata County: obtain the current use and permitting determination for the address. Neither a reserved code heading nor an older guidance letter means rentals are unrestricted.

Build a property evidence packet

  • Parcel, boundary and zoning evidence, dated.
  • Permit, conditions, capacity, expiry and new-owner requirements.
  • Recorded covenants, amendments, current HOA rules and written use confirmation.
  • Approved bedrooms and wastewater capacity where applicable.
  • Insurance quote, lender-use requirements and tax questions for appropriate advisers.
  • A named person responsible for checking remaining questions before your decision.

Use a real stop condition

If renting is necessary for affordability, unresolved permission is a material issue. Bring it to Ed and the relevant professionals before an offer or contractual deadline. The outcome may be a different property, a different use plan or no purchase.
